These Terms of Service ("Terms") govern your access to and use of the KitSociety online store, website, products, and related services.

Throughout these Terms, "KitSociety," "we," "us," and "our" refer to KitSociety.

By accessing our Site or purchasing a product from us, you agree to these Terms.

If you do not agree with these Terms, you should not use the Site or place an order.

1. Online Store Terms

By placing an order, you represent that you have the legal capacity to enter into the transaction or that the transaction is being completed with the authorization of a parent or legal guardian where required.

Product measurements may have reasonable manufacturing tolerances.

Images are intended to represent the product as accurately as reasonably possible.

4. Product Availability

Products and sizes are subject to availability.

Adding a product to your shopping cart does not reserve inventory.

We may limit quantities or discontinue products at any time, subject to obligations relating to orders already accepted.

If an ordered product becomes unavailable, we will contact you and provide an appropriate resolution, which may include cancellation and refund.

5. Prices and Currency

Unless otherwise clearly stated, prices displayed by KitSociety are denominated in United States dollars (USD).

Prices may change at any time before an order is placed.

Once an order has been accepted, price changes will not retroactively affect that order except where necessary to correct an obvious pricing error and permitted by applicable law.

Taxes, shipping fees, and other applicable charges, if any, will be disclosed during checkout as required.

6. Promotions and Discounts

Promotions may be subject to separate conditions, including:

  • Start and end dates;

  • Eligible products;

  • Minimum purchase requirements;

  • Quantity requirements;

  • Limits per customer.

Promotional offers cannot be combined unless expressly stated.

If products qualifying for a bundle or multi-buy promotion are returned, the refund may be recalculated to reflect the terms of the original promotion, to the extent permitted by law.

You agree to provide accurate, complete, and current information when making a purchase.

You are responsible for ensuring that your:

are accurate before submitting an order.

KitSociety is not responsible for delivery problems resulting from inaccurate information supplied by the customer, except where otherwise required by law.

8. Order Acceptance

Submitting an order does not necessarily mean that it has been finally accepted.

We may verify:

  • Payment;

  • Product availability;

  • Shipping information;

  • Fraud indicators; and

  • Other transaction details

before processing an order.

We reserve the right to cancel or refuse an order for legitimate reasons, including suspected fraud, inventory errors, obvious pricing errors, payment authorization failures, or inability to fulfill the order.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

9. Payments

Payments may be processed through third-party payment service providers.

By submitting payment information, you represent that you are authorized to use the selected payment method.

You authorize the applicable payment provider to charge the amount shown at checkout in USD, together with applicable taxes, shipping charges, or other disclosed fees.

10. Shipping

Shipping is governed by our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates unless expressly represented as guaranteed.

Where applicable, KitSociety will comply with U.S. laws relating to shipment timing, delays, cancellation, and refunds.

11. Returns and Refunds

Returns, exchanges, refunds, and defective products are governed by our Return & Refund Policy, which forms part of these Terms.

Nothing in these Terms limits rights that cannot legally be waived.

Personal information submitted through the Site is handled in accordance with our Privacy Policy.

  • Contains abusive or threatening material.

To the extent permitted by law, you grant KitSociety a non-exclusive, worldwide, royalty-free license to use content voluntarily submitted for review, marketing, customer service, and Site operation purposes.

15. Intellectual Property

Unless otherwise indicated, the KitSociety name, original Site content, text, graphics, layout, branding, and other proprietary materials created by or for KitSociety are protected by applicable intellectual property laws.

Third-party trademarks, logos, team names, league names, club names, manufacturer names, player names, and related intellectual property remain the property of their respective owners.

No use of third-party intellectual property on or in connection with a product should be interpreted as transferring ownership of that intellectual property to KitSociety.

16. Prohibited Uses

You may not use the Site:

  • For unlawful activities;

  • To violate applicable regulations;

  • To infringe intellectual property rights;

  • To harass or harm others;

  • To transmit malware;

  • To scrape or harvest information unlawfully;

  • To interfere with Site security;

THIS DISCLAIMER DOES NOT EXCLUDE ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITSOCIETY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SITE OR PRODUCTS.

TO THE EXTENT PERMITTED BY LAW, KITSOCIETY'S AGGREGATE LIABILITY RELATING TO A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT IN USD ACTUALLY PAID TO KITSOCIETY FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply where liability cannot legally be limited or excluded.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold KitSociety harmless from third-party claims resulting from your unlawful use of the Site, violation of these Terms, or infringement of another person's rights.

21. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.

22. No Waiver

Failure by KitSociety to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

23. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, Legal Notice, and other policies displayed on the Site, constitute the agreement governing use of our services to the extent applicable.

24. Governing Law

These Terms are governed by applicable laws of the United States and applicable state law having jurisdiction over the transaction or dispute.

Nothing in this section deprives a consumer of protections that cannot lawfully be waived.

25. Changes to These Terms

We may update these Terms periodically.

Changes will become effective when the revised Terms are posted, subject to applicable law.

The "Last Updated" date will indicate the most recent revision.
